About This Policy

This SSCo Privacy Policy (this "Privacy Policy") describes how Spraying Systems Co. and its affiliates (collectively, "SSCo", "we" or "us") collect and use your Personal Data and the choices you can make and the rights you, as a Data Subject, can exercise in relation to your Personal Data.

This Privacy Policy applies to the collection and processing of Personal Data (i) through all SSCo user applications, web services, and websites (an overview of all SSCo websites can be found on https://www.spray.com/company/global-websites) (collectively, the "Sites"), and (ii) all commercial relations between SSCo and its customers, prospects, business partners and visitors of the Sites.

Purchasing SSCo's products, engaging SSCo's services and any communication with SSCo, whether or not through the Sites, implies your explicit approval (via disclosure of your Personal Data or opt-in consent) of this Privacy Policy and consequently how we collect, use and process your Personal Data. To the extent that SSCo provides you with notice through our Sites of different or additional privacy policies or practices (e.g., at the point of collection), those additional privacy policies shall govern such data collection and use.

Personal Data of SSCo employees, job applicants, and contractors are not subject to this Privacy Policy but will be covered under separate SSCo policies and procedures.

"Personal Data" means any information that personally identifies you or from which you could be identified either directly or indirectly. Personal Data does not include information that is anonymized. "Data Subject" is an individual who can be identified, directly or indirectly, by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

1. Types of Personal Data Collected

SSCo collects the following types of Personal Data:

  • Contact person information: first name, last name, job title, salutation, language, phone number, email address, fax, contact preferences.
  • Business information: company name, country of residence, postal address, city, state, postal code, telephone number, email address, shipping postal address, billing postal address, the market in which you operate and the application in which you intend to use SSCo's products.
  • Purchase information: information collected in connection with your purchases, such as payment information and information related to creditworthiness.
  • Technical information: information related to technical data, including IP address, device type, browser type, referring website, websites accessed during your visit, the date and time of the visitor request.
  • All other Personal Data voluntarily communicated to SSCo (e.g., during correspondence, by completing the contact form, etc.)

2. Methods of Personal Data Collection

Personal Data is collected by SSCo in the context of:

  • Visiting the Sites.
  • Collaboration with SSCo.
  • Incoming and outgoing correspondence with SSCo (via email and/or telephone).
  • Subscribing to newsletters (SprayNews).
  • Registering for a SSCo event and/or seminar.
  • Chatting with SSCo customer service.
  • Completing the contact form on the Sites for SSCo's services.
  • Placing an order for SSCo's products.

Providing specific pieces of personal information may be required to enjoy certain SSCo services (e.g. to attend an SSCo event or seminar, to chat with SSCo or to contact SSCo via the contact form on the Sites). In this respect, it shall be indicated what specific Personal Data you must provide to enjoy such services.

3. Use of Personal Data

SSCo has established processes to manage the collection, processing, use and security of your Personal Data and has granted its staff permission to access your Personal Data when necessary to perform their job functions. Unless a longer storage period is required (i) by law, or (ii) through compliance with another legal obligation, SSCo shall only store your Personal Data for the period necessary to achieve and fulfil the purpose in question listed below.

a. Business Purposes
SSCo uses your Personal Data for the following purposes business purposes:

  • Performance of the agreement with SSCo, including follow-up thereof.
  • Providing you with technical and informational support regarding SSCo's products.
  • Providing you with the products, services, literature, and information upon request to SSCo.
  • Creation of your account and the confirmation thereof.
  • Confirmation of a registration for a SSCo event or seminar.
  • Incoming and outgoing correspondence with SSCo (via email and/or telephone).
  • Providing customer service/support/assistance.
  • Sending newsletters (SprayNews).
  • Enhancing your customer service experience.
  • Providing you with offers and promotions based on your communication preferences and - where applicable - upon explicit consent.
  • Communicating with you about your account or transactions with SSCo, including changes to SSCo's Sites, purchasing policies, prices, and this Privacy Policy.
  • Improving SSCo's service offerings and response times to customer inquiries.
  • Investigating fraud or preventing activities that violate SSCo policies or existing law.

b. Legal Basis
SSCo may also use your Personal Data on the following legal bases, as the case may be:

  • You have given consent to the processing of your Personal Data for one or more specific purposes.
  • In connection with the performance of an agreement with SSCo.
  • Compliance with a legal obligation to which SSCo is subject.
  • To protect your vital interests or of another natural person.
  • As necessary to perform a task carried out in the public interest.
  • Processing is necessary for furthering legitimate interests pursued by SSCo or by a third party.

4. Sharing of Personal Data

SSCo shall not disclose your Personal Data to third parties, unless it is necessary for one of the business or legal purposes mentioned above (including but not limited to accounting, marketing, transport of deliveries, payment processing, database management and the delivery of services to SSCo). Any third party SSCo uses as an agent to perform task(s) on behalf of and under the instructions of SSCo are contractually bound to treat the information in a manner consistent with this Policy. In this respect, your Personal Data may be disclosed to:

  • Within the SSCo corporate group to the extent such sharing of Personal Data is necessary to fulfill a request you have submitted via our Services or for marketing, technical operations, and account management.
  • With SSCo's contracted vendors and consultants who provide services such as IT, system administration and hosting, payment providers, software providers, customer support, cloud partners, and transport partners.
  • In connection with a merger or acquisition involving the sale or transfer of all or a majority of SSCo's assets to another company, in which case your Personal Data - which SSCo has collected - shall be one of the transferred assets.
  • Competent authorities (i) if SSCo is obliged to do so under the law or under legal or future legal proceedings and (ii) to safeguard and defend our rights.

5. Your Privacy Rights and Choices

Where required by applicable law, and depending on your jurisdiction, you may have access to certain consumer rights. For example, the right to obtain confirmation that we maintain certain Personal Data relating to you, to verify its content, origin, and accuracy, as well as the right to access, review, port, delete, or to block or withdraw consent to the processing of certain Personal Data (without affecting the lawfulness of processing based on consent before its withdrawal), by contacting us as described in Section 16 below. Please review Section 11 of this Privacy Policy below for more information regarding these rights and additional rights given to EEA and UK residents.

SSCo allows you to opt-out of whether your Personal Data is (i) disclosed to a third party; or (ii) to be used for a purpose that is materially different from the purpose(s) for which it was originally collected or subsequently authorized by you. You can exercise your opt-out right from SSCo using your Personal Data in either of the cases outlined in items (i) and (ii) above or your other privacy rights towards SSCo by directly contacting us via email [email protected] or via an authorized third party with a specific power of attorney.

Where and as permitted under applicable law, SSCo may process your contact information for marketing purposes. If you no longer wish to receive newsletters or information about the services and/or products of SSCo, you can unsubscribe at any time by clicking the "unsubscribe" link under each of SSCo's marketing emails. To protect your privacy, we may ask or additional information to verify your identity for us to respond to your request.

6. Cookie Policy

SSCo automatically collects information regarding your use of the Sites via "cookies". Cookies are small text files that are sent to and stored on your computer or mobile device through your browser when you visit a website or use a mobile application. When you visit the same website later, the data stored in that cookie can be retrieved by the website to notify the website of the last activity. Cookies serve as a reliable mechanism for websites to remember the status of the website or the previous activity of a certain user. They help us to optimize your visit to the Sites, to remember technical choices (e.g., choice of language, newsletter, etc.) and to offer more relevant services and offers.

a. Cookies the Sites Use
Cookies are commonly classified among the categories listed below.
By origin:

  • First-Party Cookies. Served directly to your device from the Sites and are accessed by SSCo to recognize your device. They might include cookies related to third‐party service providers, so first‐party cookies might log user‐related information accessible to and processed by third parties.
  • Third-Party Cookies. Stored and accessed on your device by third parties determining the purposes and means of the processing of your Personal Data logged by such cookies. SSCo has these third parties serve these cookies to you for advertising our products and services and to track analytics about the Sites.

By duration:

  • Session Cookies. Collect information about what you do during a browsing session each time you visit the Sites. When connecting to a server, your device will be assigned a session ID, which enables the server to identify your device during the session and facilitates website usability. These cookies are temporary and are set to be deleted when leaving the Sites or ending a session.

SSCo uses web beacons, tracking pixels, or cookies in combination with tools. The following are specific types of cookies that SSCo uses:

Strictly necessary: Enables basic functions that makes our Sites usable, like page navigation and access to secure areas of the Sites. The Sites cannot function properly without these cookies.

Functionality and Statistics. Helps SSCo understand how visitors interact with the Sites by collecting and reporting analytics anonymously.

Preferences. Allows our Sites to remember information that changes the way the Sites behave or look, like your preferred language or the region where you are located.

7. Automated Decision Making

We do not use automated decision making or profiling (an automated analysis of and decision making based on your Personal Data or personal circumstances).

8. Children

The Sites are intended for business use, SSCo does not knowingly collect any Personal Data from persons younger than the age of 18, or otherwise as prohibited by applicable law.

9. Security of Personal Data

The security and safety of your Personal Data is SSCo's top priority. SSCo implements technical, administrative and physical security measures designed to protect your Personal Data from (i) unauthorized access or disclosure; and (ii) loss, abuse or alteration.

If applicable, all purchase information is stored in a secured database, whereby order information is segregated from certain purchase information (such as encrypted credit card information).

Notwithstanding SSCo's security policy, the checks it carries out and the actions it proposes in this context, an infallible level of security cannot be guaranteed. Because no method of transmission over the internet or any method of electronic storage is 100% secure, SSCo is, in this context, not in a position to guarantee absolute security.

10. Other Websites

The Sites may potentially contain hyperlinks to other websites. When you click on one of these links, you may be redirected to another website or internet source that could collect information about you through cookies or other technologies. SSCo does not bear any responsibility, liability or control authority over these other websites or internet resources, nor about their collection, use and disclosure of your Personal Data. You must check the privacy statements of these other websites and internet sources to judge whether they act in accordance with applicable privacy law.

11. Your Rights – European Economic Area (EEA) and United Kingdom (UK) Residents

This Section applies only to Data Subjects in the EEA and UK. Under EU Regulation 2016/679 of the European Parliament and the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, including the United Kingdom’s substantially similar law as it takes effect in the United Kingdom by virtue of the Data Protection Act 2018 (collectively, the “GDPR”), you have a number of rights when it comes to your Personal Data. Further information and advice about your rights can be obtained from the data protection regulator in your country of residence. You can exercise any of these rights by contacting us through our email or mailing address in Section 16 “Contact SSCo” below. GDPR grants you, as a Data Subject, the following rights:

  • Right to be informed. You have the right to be provided with clear, transparent and easily understandable information about how SSCo uses your Personal Data and your rights. This is the purposes of this Privacy Policy.
  • Right to withdraw consent. You have the right to withdraw your consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before the withdrawal.
  • Right of access. You have the right to know whether SSCo processes Personal Data and, if so, certain details concerning the processing of your Personal Data. You have the right to request a copy of the personal data undergoing processing.
  • Right to rectification. You can request to correct or supplement the Personal Data provided to us if it is inaccurate or incomplete.
  • Right to erasure ('right to be forgotten'). Enables you to request us to delete your Personal Data. Please be aware that certain services will no longer be accessible and/or can no longer be provided (e.g. delivery of the ordered products) if you request deletion of certain required Personal Data.
  • Right to object to processing. You can object to the processing of your data at any time, unless there are legitimate reasons for proceeding with the processing that prevail over yours, for example for the exercise of a right or our defense in court.
  • Right to restrict processing. You have rights to block or suppress further use of your Personal Data. When processing is restricted, we can still store your Personal Information, but may not use it further.
  • Right to data portability. You can request to receive the data you provided, or to send it to another entity indicated by you, in a commonly used structured format readable by automatic device.
  • Right to lodge a complaint. You have the right to submit a complaint to or appeal on the competent Data Protection Authority regarding SSCo's processing or use of your Personal Data at the addresses below:

Data Subjects have the right to opt-out from our use of their Personal Data for direct marketing purposes. To exercise this right, please click the "unsubscribe" link in any direct marketing message you may have received from SSCo.

12. Onward Transfers

Personal Data SSCo collects may be stored and processed in your region, in the United States or in any other country where we or our affiliates, subsidiaries or service providers maintain facilities. We take steps designed to ensure that the data SSCo collects under this Privacy Policy is processed as described in this Privacy Policy and according to applicable law wherever the data is collected and/or stored.

We may transfer Personal Data from the EEA and the UK to other countries that may not have the same level of data protection that applies in your jurisdiction. For Personal Data transfers from the EEA and the UK to the U.S., SSCo relies on the EU-U.S. Data Privacy Framework (the “EU-U.S. DPF”), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (the "Swiss-U.S. DPF") as further described in Section 13 below, to the extent as each of these programs remains a lawful mechanism as an "adequacy decision" under GDPR to transfer your Personal Data. Where we cannot rely on the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, or the Swiss-U.S. DPF as lawful mechanisms to transfer your personal information (including where we transfer data to countries other than the U.S.), SSCo uses appropriate cross-border transfer solutions to ensure that the recipient of your Personal Data offers an adequate level of protection, including entering into the standard contractual clauses for the transfer of European data approved by the European Commission or, where required, we will ask you for your prior informed consent.

In cases where SSCo transfers your Personal Data processing by the third party shall be governed by a contract or other legal act, under EU or UK law where required, that obligates the third party to process your Personal Data at least as restrictive as SSCo itself and that sets out (i) the subject-matter and duration of the processing, (ii) the data may only be processed for the limited and specified purposes consistent with the consent provided by you, (iii) the type of Personal Data, and (iv) categories of Data Subjects and the obligations and rights of SSCo; (v) notification to SSCo when the third party determines it cannot meet its contractual requirements or provide an adequate level of security along with further action by the third party to either cease processing or remediate the issues present upon such an occurrence.

13. Data Privacy Framework (for Spraying Systems Co. and TeeJet Technologies LLC only)

SSCo complies with the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF as set forth by the U.S. Department of Commerce. SSCo has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (the “EU-U.S. DPF Principles”) regarding the processing of Personal Data received from the EEA in reliance on the EU-U.S. DPF and from the United Kingdom in reliance on the UK Extension to the EU-U.S. DPF. SSCo has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (the "Swiss-U.S. DPF Principles") regarding the processing of Personal Data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this Privacy Policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. Principles, the Principles shall govern. SSCo's participation in the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF applies to all Personal Data that is subject to this Privacy Policy and that is received from the EEA, the UK and Switzerland and processed by SSCo. We will comply with the DPF Principles in respect of such Personal Data. To learn what types of Personal Data we collect and process and the purposes of such processing, please refer to Sections 1-3 of this Privacy Policy. Information about the types of third parties to which we disclose your Personal Data and the purposes for which we do so are described in Section 4 “Sharing of Personal Data” above.

In accordance with the DPF Principles, EEA, UK, and Swiss individuals have certain rights described in Section 12 “Your Rights - European Economic Area (EEA) and United Kingdom (UK) Residents" that may be exercised at any time upon request to SSCo via email or mail at the address listed in Section 16 "Contact SSCo" below. If we have received your Personal Data in the United States and subsequently transfer that data to a third party acting as an agent, and such third-party agent processes your Personal Data in a manner inconsistent with the DPF Principles, we will remain liable unless we can prove we are not responsible for the event giving rise to the damage.

SSCo is subject to the investigatory and enforcement powers of the Federal Trade Commission (FTC).

In certain situations, SSCo may be required to disclose Personal Data that we process under the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF in response to lawful requests by public authorities, including to meet national security or law enforcement requirements, or to enforce contractual obligations.

In compliance with the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF, SSCo commits to cooperate and comply respectively with the advice of the panel established by the EU data protection authorities (DPAs), the UK Information Commissioner’s Office (ICO), and the Swiss Federal Data Protection and Information Commissioner (FDPIC) with regard to unresolved complaints concerning our handling of personal data received in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF. This service is provided free of charge to you.

If your DPF complaint cannot be resolved through the above channels, under certain conditions, you may invoke binding arbitration for some residual claims not resolved by other redress mechanisms under Annex I of the DPF Principles. 14. Changes to this Privacy Policy

SSCo reserves the right to alter, amend or update this Privacy Policy, as deemed necessary to accommodate changes in technology, industry practice, and legal or regulatory developments. When posting a new version on the Sites, SSCo will indicate the revision date at the end of this Privacy Policy. As such, SSCo strongly recommends that you regularly consult the Sites and the page displaying the Privacy Policy to make sure that you are aware of any changes.

15. Verification

We will verify on a regular basis whether this Privacy Policy and our data protection processes and procedures are in line with applicable laws. To this end, we will either perform a self-assessment or engage in an outside compliance review, either directly or with the assistance of one or more third parties.
